I understand that Marine's pride. I think he has a right to fly it on that pole. I personally would not have chosen a 20 ft flagpole in an urban setting to fly my flag but that's what he preferred. He's flying an AMERICAN flag, nothing offensive or improper, I don't see the problem. He's a veteran and he has more right than most (I believe) to fly anything he pleases on that pole. It's not hurting anyone or anything, I see no point to suing him.

on a side note: I can TOTALLY see my husband, ALSO a Marine, doing this xD and I would TOTALLY help him <3

First off I think its ridiculous that anyone would take this to court its a flippin flag and its not offensive or hurting anyone. On the other hand however, he chose to live in a community with a home owners association. You know that when you move into an area with a HOA they can dictate what is and is not allowed on your property
